Denim Dish – Levi’s In Focus

                                                levis-trade-dress.jpg                                                              We recently read about a pair of vintage Levi’s that were found in a mine in the Mohave Desert.  They appear to be dated from around 1895 and were in pretty decent condition all things considered, and what happened to these vintage jeans?  They were sold on eBay of course, for over 36k!!!This got us thinking about our own experiences with Levi’s.  While Levi’s are our tried and true favorites, they have caused much stress to us professionally.  Levi’s were the leader in denim apparel, originally made for workers traveling out west during the gold rush; they have since become a wardrobe staple.  However, Levi’s are now the trailblazers of a wholly different trend, lawsuits!!!  Levi’s famous back pocket embroidered logo, or what it is technically known as United States patent #1139254, has caused a whole lot of trouble.  Levi’s has sued over 100 companies since 2001 for trademark infringement.  Some of these are larger companies: Guess, Von Dutch, Lucky Brand, Esprit, Rock & Republic, but there are many smaller manufactures as well.  Many of these lawsuits have no merit, but rather than going to court they settle and Levi’s makes money.  Many in the industry believe that this is Levi’s way of turning a profit since they have been losing money and on the verge of bankruptcy for years.So all you denim designers, assistant designers, graphic designers, and CAD designers you must be extra cautious when designing back pocket embroideries and logos.  They will go after any design that is at all similar to their patented V arch shape.  Do not try to flip it, rotate it, mirror it, or elongate it; they will go after you.  And don’t even think about using a red flag label on the back pocket either.  Don’t forget to be extra diligent when hiring free lancers or art studios to do any sort of embroidery for your denim product.  Good luck everyone!
